Membership Agreement
MEMBERSHIP AGREEMENT
Old Town Hot Springs is a not-for-profit organization and members are subject to and agree to the terms of the articles and bylaws of the organization.
1. Membership Types:
12‑Month Paid‑in‑Full (PIF) Memberships
- Up‑front payment for a fixed 12‑month term.
- Does not auto‑renew.
- No refunds except as required under Colorado health‑club law (death, total disability, relocation/closure of business).
1‑Month Auto‑Renew Memberships
- Bills monthly until canceled.
- Requires 30‑day advance written notice to cancel.
- OTHS will provide 60‑day advance notice of any rate increase.
- Membership must remain active (not frozen or delinquent) for any metered product use (swim lessons, or childcare).
- Members selecting this membership must sign the Auto-Renew Authorization which is incorporated into this agreement.
Family Definition
A “Family Membership” includes one or two adults in a spousal/partner relationship and their legal dependents under age 24 living at the same physical address. Nannies, caregivers, grandparents, cousins, and extended family are not eligible.
2. Account Rules
- Memberships are non‑transferable and cannot be shared.
- Key‑tag sharing may result in suspension or termination.
- Only the Primary Member may request membership changes.
- OTHS may require proof of residency, age, or dependent status.
3. Cancellation & Notices
Paid-In-Full Memberships
- Expires automatically at the end of the 12‑month term.
- No auto‑renewal.
1‑Month Auto‑Renew Membership
- Cancellable with 30 days’ notice.
- Cancellation is effective 30 days after OTHS receives your written notice here:
- Billing continues during notice period.
- For example, a member informs OTHS of intent to cancel membership on April 25th. OTHS will bill for the cost of the membership on May 1st and will set the membership to expire on May 31st.
- OTHS may modify or discontinue auto-renew memberships and will provide advanced written notice of any material changes.
- OTHS will provide 60 days’ written notice before any rate increase for 1‑Month Auto‑Renew memberships.
Statutory Rights Under Colorado Health‑Club Law
Regardless of membership type, members may cancel and receive prorated refunds if:
- If it has been three days or less since signing the Membership Agreement,
- The member dies,
- The member is totally and permanently disabled for the contract duration (medical documentation required),
- OTHS relocates more than 5 miles from current location, or
- OTHS permanently discontinues operation.
Refunds processed within 15 days of written notice.
4. Billing & Payment
- Monthly dues (for Auto‑Renew) post on the 1st business day of each month.
- Members are responsible for maintaining valid payment information.
- Failed payments may result in suspension until the account is current.
- OTHS may collect unpaid balances for past‑due charges.
- OTHS reserves the right to apply late fees to delinquent accounts based on the cost to the organization to collect past due balances.
- Any person(s) signing this agreement authorizes the use of a disclosed cell phone or telephone number for autodialed or pre-recorded voice calls and text messages for billing-related issues including, but not limited to, expiring billing information or overdue account balances.
5. Facility Access & Amenities
Included amenities: pools, fitness center, group exercise classes, climbing wall (during posted hours), sauna, discounted guest admission.
Additional fee amenities: waterslides, childcare, lessons, massage, personal training, towel rentals, room rentals, climbing gear rentals, and specialty programs.
Locker use:
- Day‑use lockers are cleared nightly.
- Rented lockers may be opened by OTHS for safety or sanitation. An Old Town Hot Springs lock will be provided and must be used.
6. Maintenance & Closures
OTHS may temporarily close facility areas for repairs, construction, classes, weather, or events. Dues are not reduced for temporary closures.
7. Code of Conduct
All members agree to comply with the OTHS Code of Conduct.
8. Media Release
By becoming a member of Old Town Hot Springs, members understand and agree that OTHS may photograph or record activities, programs, and general facility use. Members grant OTHS full permission to use image, likeness, and voice (including any minor dependents on the membership) in any promotional or educational materials, including print, digital, social media, and advertising, without expectation of compensation and without the ability to opt out.
OTHS will not identify individuals by full name without consent.
9. Governing Law
This Agreement is governed by Colorado law.
10. LIABILITY WAIVER & ASSUMPTION OF RISK
PLEASE READ CAREFULLY — THIS SECTION LIMITS YOUR LEGAL RIGHTS
By entering OTHS property or participating in OTHS activities, I acknowledge, understand, and agree:
- Inherent Risks: Aquatic, fitness, climbing, and recreational activities involve risks of injury, illness, falls, drowning, impact injuries, equipment failure, and exposure to natural mineral water, weather, and actions of others.
- Assumption of Risk: I freely and voluntarily assume all such inherent risks for myself and my dependents.
- Release for Ordinary Negligence: To the fullest extent permitted by Colorado law, I release OTHS, its employees, officers, and insurers from all claims arising from ordinary negligence.
- Not Released: This waiver does not release claims arising from gross negligence, willful/wanton acts, or reckless conduct.
- Indemnification (Third‑party claims): I will indemnify OTHS for damages caused to others due to my or my dependent’s misconduct or rule violations.
- Care of minors: I agree to be solely responsible for safety and well-being of any minor(s) in my care and myself. I understand that OTHS does not provide supervision, instruction, or assistance for the use of the facilities and equipment.
- Climbing Wall: I acknowledge special risks inherent in climbing and falling and agree to follow all posted rules and instructions.
- Medical Treatment: I authorize OTHS to obtain emergency care if needed and accept responsibility for costs.
- Property Loss: OTHS is not responsible for lost, stolen, or damaged property.
